Terms of Service

1. Eligibility

You must be at least 18 years of age and a legal resident of the United States to use VividSub. Contractors must hold all licenses, certifications, and insurance required by applicable law.

2. Description of the Platform

VividSub is an online marketplace connecting homeowners and general contractors with independent subcontractors. VividSub is a technology platform only. We do not perform work, employ contractors, or guarantee the quality of any work performed.

3. User Accounts

You must provide accurate information during registration. You are responsible for all activity under your account. Each person may maintain only one account.

4. Job Posters

Free tier: up to 2 active jobs, fixed price only. Pro tier ($29/month or $249/year): unlimited jobs, sealed bidding, job boosts, and analytics. Job posters are solely responsible for selecting contractors.

5. Contractors

Basic Verified (free): requires valid insurance and license verification. Elite Vetted ($49/month or $399/year): requires background check, references, and portfolio review. Elite contractors receive 24-hour early access to new jobs.

6. Bidding Rules

Contractors may submit one bid per job. Bids are sealed and final. Submitting bids with no intention to perform the work is grounds for account termination.

7. Prohibited Conduct

Users may not: solicit contact outside the platform before job award, submit fake reviews, harass other users, misrepresent credentials, use the platform for illegal purposes, or share account credentials.

8. Payment Terms

Subscription fees are billed in advance and are non-refundable except as required by law. Price changes will be communicated 30 days in advance. VividSub is not responsible for payment disputes between users.

9. Reviews

Reviews must be honest and based on real experience. VividSub may remove reviews that violate these Terms.

10. AI Cost Estimator

Estimates are approximations only and do not constitute a quote or guarantee. Actual costs may vary significantly.

11. Intellectual Property

VividSub owns all rights to the Platform. You retain ownership of content you submit but grant VividSub a license to display it in connection with the Platform.

12. Disclaimers

THE PLATFORM IS PROVIDED AS IS WITHOUT WARRANTIES OF ANY KIND. VIVIDSUB DOES NOT GUARANTEE THE QUALITY OR COMPLETION OF ANY WORK.

13. Limitation of Liability

VIVIDSUB'S TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF AMOUNTS PAID TO VIVIDSUB IN THE PRIOR 12 MONTHS OR $100.

14. Indemnification

You agree to indemnify VividSub from claims arising from your use of the Platform, your violation of these Terms, or work you perform through the Platform.

15. Dispute Resolution

Disputes shall be resolved through binding arbitration in Michigan under AAA Consumer Arbitration Rules. Class action waiver applies.

16. Governing Law

These Terms are governed by the laws of the State of Michigan.

17. Changes

We may update these Terms with 14 days notice. Continued use constitutes acceptance.
